Terms & Conditions for purchase from DANISH DIVERS A/S

The following Terms and Conditions apply to all deliveries from DANISH DIVERS A/S.

Conditions apply in cases where no other written agreements between you as buyer and DANISH DIVERS A/S.

Right of cancellation
DANISH DIVERS A/S provides a general 14 day right of cancellation, valid from the day you receive your goods.

The right of cansellation, however, do NOT cover products which we have marked as "Made-to-Order", as these will only be ordered from the manufacturer in the United States upon receipt of your order. This means that we are not able to provide right of cancellation of these products, since returning to the manufacturer is associated with inordinately high costs.

If we receive notice that you regret your purchase BEFORE we have ordered the product from the manufacturer, it is possible to cancel your purchase. Only written accepts from DANISH DIVERS A/S will have liberating effect.

We consider that you have accepted the limited right of cancellation if you order a product marked "Made-to-Order".

To claim your right of cancellation, you must, within 14 days from the date for the reception of your products, give us the notification that you want to cancel your purchase. The notification shall be given by completing the form at the following link and send it to us by post or e-mail.

Please note: You cannot cancel your purchase, by rejecting the products, without giving us a notice of this.
To claim your right of cancellation, the procucts must be handed over to the PostNord or other courier within 14 days from reception of the products.

The condition for the cancellarion is that the item is returned in the same condition and quantity as when you received it. If the item is not returned in the same condition as you received it, DANISH DIVERS A/S will determine the value, on the basis of a realistic sales price. Underwater housings, strobes and other equipment used underwater, will usually have a significant deterioration of the sales value. You will, based on a specific assessment by DANISH DIVERS A / S, will be credited with an equivalent smaller amount corresponding to the depreciation.

As underwater housings and other technical equipment used in water requires careful operation and maintenance to operate under water, it will in some cases not be possible to resell such product that has been in use.

Missing original packaging and accessories usually generate a deterioration of the sales value, why you based on an assessment made by DANISH DIVERS A/S, will be credited to a correspondingly lower amount equal to depreciation. At worst, missing original packaging etc. can result in that the purchase can not be canceled.

You must pay the costs associated with returning the goods.

Documentation and guidance

If there are product descriptions and manuals for the product, they will follow the delivery. However, please be aware that these often will be in English, since most products imported from abroad.

All goods are sent by Post Denmark, unless otherwise decided by the buyer. We charge shipping fee equal to Post Danmark's current tariffs.
Stock items are dispatched basically the same day we receive the order. However, we take reservations for that delays may occur. You will receive an automatic email with shipping information as soon as the product is shipped.

The products which we do not have in stock, we order at supplier immediately after we have received your order.
Non-stock items will normally be delivered within 4-10 days. You will receive an automatic email with shipping information as soon as the product is shipped.
We reserve the risk of backorder from our suppliers, and delays in shipping.

Indicative Delivery time
Stock items within 1-2 days.
Non-stock items 4-10 business days.

Risk of products
The risk of goods purchased by DANISH DIVERS A / S transferred to you as a consumer at the time of delivery.

Warranty conditions
Any errors or shortcomings in the supply must be within a reasonable time after you have discovered the error. It is your duty to tell and upon request, show how the error manifests itself. If you find an error, you must urgently contact us.

DANISH DIVERS A/S provides a 24 month warranty for private (12 months for businesses). It is considered, in consumer purchases, that reasonable time within which notice must be given about a product is within 2 months after the defect is discovered. This means that you either get your product repaired or replaced, refund or reduction in price, depending on the specific situation.
If the buyer has discovered or should have discovered the defect and not complained as stated above, the buyer can not later claim the defect. DANISH DIVERS A/S may choose to remedy the defect or make replacement.

Non-rechargeable batteries supplied in/with a product is for meant for test of the product only. There is no guarantee for the supplied battery life.

Used and demo (OUTLET)
1 year's warranty on items sold as used and demo via our OUTLET section. All products are always fully functional and thoroughly tested before delivery.
Missing accessories, manuals etc. may occur. The general right of cancellation as described above also apply to items in this category.
If errors/defects occur we can not guarantee to replace the product, since in some cases it is unique items.

Price and payment
All prices include VAT (unless you have choosed to see the price excl VAT). VAT. In stock items amount is withdrawn when we send goods to you. A "Made-to-Order" products, the amount is withdrawn when the product  is ordered from our supplier.

Information on means of redress
A complaint about a product or service purchased from us may be submitted to the Competition and Consumer Authority's Center for Complaint Resolution, Carl Jacobsen Vej 35 2500 Valby.
You can complain to the Center for Complaint Resolution via www.forbrug.dk.

European Commission's online complaint portal can also be used when filing a complaint. This is particularly relevant if you are a consumer residing in another EU country. Complaints filed here - ec.europa.eu/odr.
